Frequently Asked Questions on Delegated Regulation (EU) No 574/2014 of 21 February 2014 amending Annex III to Regulation (EU) No 305/2011 on the model to be used for drawing up a declaration of performance on construction products:

What is harmonized construction products?

We would like to inform You that harmonized construction products (The harmonized EU standards or EU evaluation documents and EU technical assessment documents prepared by producer used for construction products) should be supplied to Lithuanian market (and to any EU country) according to new regulations (Regulation (EU) No 305/2011 of the European Parlament and of the council ) from 1st of July 2013.

Regulation (ES) No 305/2011 is the direct application of EU legislation. Lithuanian norms could not contradict or supplement it, so if products cover this regulation no additional Lithuanian requirements are used.

If construction products are not covered by harmonized standards, national regulation is used for non-harmonized standards construction products.

Construction products are placed on the Lithuanian market according to the provisions of the Law on Construction of the Republic of Lithuania (Official Gazette Valstybės Žinios, 1996, No 32-788; 2001, No 101-3597; 2004, No 73-2545; 2007, No. 55-2127). Requirements for the specific construction products (harmonized and non-harmonized) placed on the Lithuanian market are set out in the List of Regulated Construction Products (hereinafter referred to as the ‘List’), approved by the Order of the Minister of the Environment of the Republic of Lithuania on an annual basis. The List is notified to the European Commission and the Member States.

Here is the new list of regulated construction products.

Our customer, construction chemicals producer, would like to know whether the CE marking on the packaging of their products sold by the company in Lithuania could be presented only in two languages - Polish and English? Is it obligatory to add the declared parameters in the national languages of those countries?

We would like to inform You that harmonized construction products (The harmonized EU standards or EU evaluation documents and EU technical assessment documents prepared by producer used for construction products) will be supplied to Lithuanian market (and to any EU country) according to new regulations (Regulation (EU) No 305/2011 of the European Parlament and of the council ) from 1st of July 2013.

Regulation (ES) No 305/2011 no foreseen any requirements regarding language information which should be placed using „CE“ marking. Additionally, it should be stated that it is a requirement to present documentation together with the construction product: declaration of performance, instructions, protection information. This documentation should be presented in-country language where the product is supplied. According new Lithuanian construction law (should be valid from 2013.07.01) changes, construction product declaration of performance, product installation, use instruction, and protection information should be presented in the Lithuanian language.

 

We are producer of industrial floor coatings. We are also selling those materials in Lithuania. In which language we have to offer the declaration of performance in accordance with (EU) No305/2011. Is a English version sufficient?"

It should be stated that it is a requirement to present documentation together with the construction product: declaration of performance, instructions, protection information, etc. This documentation should be presented in-country language where product is supplied. According to new Lithuanian construction law (valid from 2013.07.01) changes, construction product declaration of performance, product installation, use instruction, and protection information should be presented in the Lithuanian language.

We are polish-german cooperating companies. We are the manufacturer of the NIKO chimney systems (www.chimneys-niko.com, german: www.schornsteine-niko.com). We would like to check if the certificates of our chimneys (in attachment) are fully sufficient to sell and use them in Lithuania. We also comprehensively install fireplaces with surroundings throughout Europe. We use the best CE-certified fireplace inserts produced by top European, mostly german brands, such as Spartherm, Brunner, or Leda. We would like to know, if are there any specific staturory requirements in Lithuania. Or they are just the same as in Germany? As the german-polish company can we legally install fireplaces in Lithuania.

As we understood Your products are covered by European harmonized standards. In this case, all provisions of new Regulation (ES) No 305/2011 should be used.

It should be stated that it is a requirement to present documentation together with the construction product: declaration of performance, instructions, protection information, etc. This documentation should be presented in-country language where product is supplied. According to the new Lithuanian construction law (clause 18, para 16) changes, construction product declaration of performance, product installation, use instruction, and protection information should be presented in the Lithuanian language.
